Tickhill –vs- Fairwoods Solicitors Limited : 75% of legal fees reclaimed for aggrieved former client of Personal Injury Solicitor

Mr Tickhill of Mexborough, Doncaster, was involved in a Road Traffic Accident on Sunday 9th February 2020. As it was a Sunday Mr Tickhill could not contact his usual law firm that he has contacted on other occasions.

Within 48 hours, Mr Tickhill was contacted by an agent who was aware of Mr Tickhill's accident and was explained that the Third Party Insurers had "set aside" £2000.00 for any compensation claims arising from the accident, he was also told that he would not have to attend a medical examination. It is unknown whether there is any link between the agents who called Mr Tickhill and his Solicitors, Fairwoods Solicitors Limited in Preston. 

Agents attended Mr Tickhill's home the same night of the phone call to retrieve signed documentation in order to initiate the claim. Mr Tickhill attempted to double check what he'd been told about not having to attend a medical and was told "If that's what you've been told, that's what you will get". 

Mr Tickhill was then advised by his Solicitors that in order to progress the claim he must attend a medical examination. This is contrary to what Mr Tickhill was advised by the agent when he was convinced to proceed, however, as he had nothing to hide Mr Tickhill agreed to have a medical examination.

Due to the 'lockdown' restrictions caused by Covid-19, Mr Tickhill's medical examination was cancelled and was re-arranged to take place online via the very popular video call software, Zoom. 

Shortly after completing the examination, Mr Tickhill's claim settled for the gross value of £2000.00. Mr Tickhill received just £1164.00 of this after deductions were made for a "success fee" of £500.00 and £336.00 for the cost of an After the Event Insurance premium which cover the costs of disbursements and Defendant legal fees should the claim not be successful. All in all, Mr Tickhill received a cheque for just 58% of the money that was awarded to him by the Defendant Insurers as a result of his accident. 

On 23rd June 2020, Mr Tickhill signed an agreement with Checkmylegalfees.com to act as his legal representative and represent him in assessing his paid legal fees. Mr Tickhill instructed us after reading our advertisement on Facebook, Mr Tickhill was aggrieved by the charges Fairwoods Solicitors had imposed on him and thought it was worth a go. 

After extensive correspondence with the Director of Fairwoods Solicitors, a settlement was achieved with Mr Tickhill being refunded £380.00 back from the £500.00 deduction that was made in respect of Fairwood's legal fees.
