In a decision yesterday before District Judge Batchelor in the High Court in Sheffield on applications under the Solicitors Act 1974, two of our clients were awarded refunds of significant parts of the money that had been deducted from their compensation by Amanda Cunliffe Solicitors way of "success fees" at the conclusion of road traffic accident claims in 2016 and 2018 respectively.
The District Judge agreed with our argument that the success fees had been calculated both on the wrong figure, and applying the wrong percentage.
Amanda Cunliffe were criticised for having failed throughout the course of these proceedings to disclose their own contractual documentation with the clients.
We are delighted with the outcomes for these clients, who will now receive the balance of monies that were intended to compensate them for their injuries rather than paying additional legal fees to their solicitors, who had already received fixed costs from the opposing party's insurers in each accident.
It is also pleasing that the Court has, once again, recognised the importance and complexity of this type of claim.
