Employment Tribunal Fees Scrapped - £27 million to be refunded

Trades Union Unison has won a landmark case this morning in the Supreme Court against the government for the imposition of fees of up to £1,200 in Employment Tribunal cases, which severely restricted workers' access to justice.

The Supreme Court found that the government acted unlawfully and unconstitutionally when it introduced the fees in 2013.

It also found that the fees were discriminatory because "type B" claims, which include unfair dismissal, equal pay and discrimination claims attracted a higher fee of £1,200, compared with £390 for "type A" claims. This was found to put women at a particular disadvantage because a higher proportion of women bring type B than type A claims, when compared with men (as the BBC will no doubt soon find out!)

A resounding victory for workers' rights and for access to justice generally!
